Purpose of Blue Card EU for Germany

This website gives you information about the new ,Bluecard‘ for Germany. It makes easier to get a workpermit for Germany. It is a service for highly qualified experts who are looking for a job in Germany and for people who are already in Germany and want to know, if they can improve their visa status.

Info about the new Bluecard for Germany

The Government wants to attract more highly qualified experts and therefore they make it easier to get a German work permit. The new law already passed the ,Bundestag‘ on the 27th of April and the ,Bundesrat‘ on the 11th of May. Now it has to be published in the ,Bundesgesetzblatt‘ and then the law has come into effect. From an optimistic point of view we can expect this on the 1st of July 2012. The whole process is called ,Gesetzgebungsverfahren‘.

The EU Blue Card is a new residence title for specific purposes in Germany since 2012. This is addressed to well educated immigrants and has the aim to make Germany more attractive. It grants the right to work and live in Germany. Concerning to the introduction of the EU blue card in Germany, the permanent moving in of highly educated skilled employees is made easier.

At the same time as the EU blue card got introduced Germany got the advantage of a new residence law which improves the legal conditions for an occupation admission of foreign students after the end of their study at a German university.

The most important points are:
Applicants must have a degree from an accredited University or at least 5 years experience in a related profession and an employment contract from a German company about 44.800,- € which is reduced to 35.000,- € for scientists, IT-Experts, Engineers and medical Doctors.

The so called ,Arbeitsmarktcheck‘ (labourmarket check) will be cancelled. This is a very important point, because this check extended the process from the application to the visa stamp in the passport for weeks!

The rule that very high qualified persons with a minimum income of 66.000,- € can get the ,Niederlassungserlaubnis‘ from the beginning of their life in Germany will be cancelled, which is indeed a disadvantage for this group of experts.

Now every work permit holder can get the ,Niederlassungserlaubnis‘ (unlimited residence permit) after 3 years and if the applicant speaks German he can get it already after 2 years (only with a valid employment contract!). This is an improvement, before the Bluecard it was 5 years.

New is the possiblity to get a 6 month visa to search for a job in Germany! Foreign students get 18 month time to look for a job instead of 12 month, when they finished their studies succesful.

EU Blue Card
The EU blue card Germany is a residence title for specific purposes, therefore an evidence for the legal stay of a relative of a non-EU-country in an EU- member state for the purpose of working. The blue card is also a card for relatives from non-EU-states. For members of EU- states generosity is valid concerning their stay. The EU- regulations concerning the blue card will be valid in Germany as a part of the German law from the 1th July 2012 on, through the law for reaction of the high- qualification –outline of the European Union. In particular the stay law was modified. Core regulation of the stay law is the EU blue card. The most important paragraph is section 19a of the german Residence Act - EU Blue Card.

Conversion of the highly qualified directive of the European Union
Conversion of the highly qualified directive of the European Union is the basis of the EU Blue Card, namely the directive can be found in 2009 / 50 /EG. The blue card serves the purpose to grant the stay in the EU to highly qualified non-EU-state members. This should be an idea to work against the shortage of skilled workers. The rules for the administration of the single EU states are out of the rules of action of the EU. These rules do not control the immigration of citizens from non EU- states, who are staying in the EU concerning to research projects, who enter the EU because of family unification for migrants living in Germany or who cannot be deported. Owners of the EU blue card shall get the same salary as citizens of the EU do in the same job. The equalization concerning the rights for education or welfare is not yet a law but shall be practiced that way. The EU blue card is limited. The time of this limit is one to four years. The format in the EU is the same in all member states and belongs to the legal order (EG) 1030/2002.
